What is changing under the Heavy Vehicle National Law on 1 August?

The Heavy Vehicle National Law reforms sharpen the safety duties every party in the transport chain must meet and lift the consequences for getting them wrong. They tighten expectations around safety management systems, loading, fatigue and record keeping, and apply to organisations of all sizes across the supply chain.

Who do the Chain of Responsibility duties apply to?

Chain of Responsibility means the legal duty for heavy vehicle safety is shared by everyone who influences how a load moves, from the board, consignor and scheduler to the loader and driver. If your decisions affect how freight is loaded, secured or transported, the law applies to you, not just the driver.

What are the penalties for heavy vehicle compliance breaches?

Penalties are significant, and the reforms increase them. Errors in record keeping and work diaries attract penalties in their own right, and breaches of the primary safety duties carry far higher exposure, including personal liability for executives and directors. Preparing before an audit or an incident is the most cost-effective way to manage that exposure.

Do my drivers need load restraint training to be compliant?

Load restraint is one of the most scrutinised duties. Being able to show that your loaders and drivers are trained, and that your restraint methods meet the National Load Restraint Guide, is a core part of demonstrating compliance. Documented, defensible restraint methods are the evidence that stands up if you are checked.

How do I meet my Chain of Responsibility duty?

You meet it by doing what is reasonably practicable to ensure the safety of your transport activities: identify your risks, put clear controls in place for each role that influences a load, and keep the records that prove those controls are working.
